Welcome to Datafawn! These Terms of Service ("Terms") govern your access to and use of the Datafawn website (datafawn.com), including any content, functionality, and services offered on or through the website and associated platform (collectively, the "Service"), operated by Fikri Firdaus ("Datafawn", "we", "us", or "our").
Please read these Terms carefully before you start to use the Service. By accessing or using the Service, creating an account, or by clicking to accept or agree to the Terms when this option is made available to you, you accept and agree to be bound and abide by these Terms and our Privacy Policy, incorporated herein by reference. If you do not want to agree to these Terms or the Privacy Policy, you must not access or use the Service.
You must be at least 18 years old to use the Service. By agreeing to these Terms, you represent and warrant that you meet this age requirement.
To access certain features of the Service, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account.
Datafawn provides a platform for data analysis, visualization, computer vision model training, text classification model training, and prediction generation. Features include data analysis, visualization, chat with the data, model training, and prediction generation.
Beta Period: Currently, the Service is offered under a Beta Program. During the Beta Period:

Fees: Access to certain features of the Service may require a paid Subscription. You agree to pay all applicable fees for the Subscription plan you select, as described on our pricing page (Pricing Page) or as otherwise communicated to you.
Payment Processor: We use Paddle.com Market Ltd ("Paddle") as our merchant of record for processing payments. By subscribing, you agree to Paddle's terms and conditions and privacy policy. All payment information is provided directly to Paddle.
Billing Cycle: Subscriptions may be billed on a recurring basis (e.g., monthly or annually). Your Subscription will automatically renew at the end of each billing cycle unless cancelled.
Cancellation: You may cancel your Subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of the current billing cycle. No refunds or credits will be provided for partial subscription periods.
Price Changes: We reserve the right to change Subscription fees. Any price changes will be communicated to you in advance, typically with at least 30 days' notice, and will take effect at the start of the next billing cycle.
Free Trial: We offer a 14-day free trial for all paid subscription plans. During the trial period, you have full access to your selected plan's features without any charges. You may cancel at any time during the trial period without being charged.
No Refunds: Due to our generous 14-day free trial period, all payments are final once the trial period ends and your first payment is processed. You may cancel your subscription at any time through your account settings to avoid future charges, but no refunds will be provided for completed billing periods.
Cancellation: You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing cycle, and you will retain access to paid features until that time.
Ownership: You retain all ownership rights to your User Content. We do not claim ownership over any of your User Content.
License Grant: By uploading or submitting User Content to the Service, you grant Datafawn a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, adapt, process, publish, transmit, and display your User Content solely for the purpose of providing, maintaining, and improving the Service for you.
Responsibility: You are solely responsible for your User Content, including its legality, reliability, accuracy, and appropriateness. You represent and warrant that you have all necessary rights to grant the license above and that your User Content does not violate any third-party rights or applicable laws.
Data Privacy: Our collection and use of personal information in connection with the Service is described in our Privacy Policy.
You agree not to use the Service:
The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Datafawn, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
These Terms grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business or personal purposes according to your Subscription plan (or Beta access terms), subject to these Terms. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as necessary for your permitted use.
We may terminate or suspend your access to all or part of the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
You may terminate your account and these Terms at any time by cancelling your Subscription (if applicable) and ceasing to use the Service, or by contacting us.
Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that, by their nature, should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. NEITHER DATAFAWN NOR ANY PERSON ASSOCIATED WITH DATAFAWN MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICE.
WITHOUT LIMITING THE FOREGOING, NEITHER DATAFAWN NOR ANYONE ASSOCIATED WITH DATAFAWN REPRESENTS OR WARRANTS THAT THE SERVICE, ITS CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICE WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SERVICE OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICE WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL DATAFWAN, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SERVICE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

You agree to defend, indemnify, and hold harmless Datafawn, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Content, any use of the Service's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Service.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law provisions. Any dispute, controversy, or claim arising out of or in connection with these Terms or the use of the Service shall be exclusively submitted to the jurisdiction of the courts in Jakarta, Indonesia. You agree to waive any objections to such jurisdiction and venue.
We reserve the right to revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Service thereafter. We will notify you of any material changes by posting the new Terms on the site and updating the "Last Updated" date, and/or by sending an email to the address associated with your account, or by an in-app notification.
Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.
